Terms of service

These terms are the agreement between you and Whimsee Ltd for the use of Jackdaw. By creating an account you accept them.
1. What Jackdaw does
Jackdaw drafts social media posts and graphics in your voice, and can schedule the ones you approve to social accounts you connect. It learns from how your posts perform.
Jackdaw does not post anything you have not approved. Approval is the point of the product, and it is also how responsibility for what gets published stays with you.
2. Your account
You need to be 18 or over. Sign-in is by a link sent to your email address, so keep access to that address secure: anyone who can read your email can reach your account.
One account is for one business or person. Tell us at hello@whimsee.co.uk if you think someone else has got into it.
3. Plans and payment
Prices are shown in the app and include no VAT at present. Paid plans are billed monthly in advance through Stripe, and renew automatically until you cancel. We never see or store your card details.
Each plan comes with a monthly allowance of AI-drafted ideas and a limit on connected accounts. Allowances reset on the first of each calendar month and do not roll over. Refining a draft you already have does not count against the allowance.
If a payment fails we will keep your service running while Stripe retries. If it keeps failing, the subscription ends and posting stops.
4. Cancelling and refunds
You can cancel at any time from the billing page. Cancelling stops the next payment; the plan runs to the end of the period you have paid for.
If you are a consumer rather than a business, you have a legal right to cancel within 14 days of subscribing. Because the service is available immediately, using it in that period may reduce what you get back.
Outside of that, we do not refund part-months, but if something has gone genuinely wrong then email us and we will sort it out.
5. Your content
What you put into Jackdaw, and what it drafts for you, is yours. We claim no ownership of it and we do not use it to train AI models.
We need your permission to store it, show it back to you, send it to the services listed in the privacy policy, and publish it to the accounts you connect. That permission lasts as long as your account does.
You are responsible for what you publish. That includes having the rights to any photos you upload, and following the rules of each social platform.
6. What Jack writes
Drafts are produced by an AI model. They can be wrong, awkward, or say something you would not. Read them before you approve them. We do not warrant that a draft is accurate, original, or fit for any particular purpose, and we are not responsible for what happens after you approve one.
This is why nothing publishes without you.
7. Connected social accounts
Publishing runs through a third-party provider that holds the connection to each platform. We never see your social media passwords.
We do not control Instagram, LinkedIn, X, Facebook or any other platform. They change their rules and their APIs, they can rate-limit or suspend accounts, and a post can fail for reasons on their side. We are not responsible for that, though we will tell you when we know about it.
8. Acceptable use
Do not use Jackdaw to publish anything unlawful, harassing, hateful, deceptive, or in breach of someone else's rights. Do not use it for spam, for impersonating a real person or organisation, or to generate content about someone in order to target them.
Do not try to break the service, get at other customers' data, or work around your plan's limits.
We can suspend or close an account that does any of this, without a refund.
9. Availability
We try to keep Jackdaw running and we will not pretend to promise a percentage. It is a small service on a single server, and it depends on other companies' systems. There will be maintenance, and occasionally there will be outages.
10. Our liability
Nothing here limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit.
Subject to that, we are not liable for lost profits, lost business, lost goodwill, or for content that was published after you approved it. Our total liability to you in any twelve-month period is limited to what you paid us in that period.
If you are using Jackdaw for a business, you accept that this limit is reasonable given what the service costs.
11. Ending it
You can close your account at any time by emailing hello@whimsee.co.uk. We will delete your data as described in the privacy policy.
We can end this agreement with 30 days' notice, or immediately if you breach section 8. If we end it without cause, we will refund the unused part of what you have paid.
12. Changes
We may change these terms. If a change matters to you, we will email you at least 14 days before it takes effect, and you can cancel if you do not like it. The date at the top tells you when this version was written.
13. Law
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
